Dooke Tech provides automation software and consultation services. This Data Processing Agreement (“DPA”) forms part of the Terms of Service between DOOKE LLC, doing business as DOOKE TECH (“Processor”, “Company”), and the user or business using the platform (“Controller”, “User”, “Client”).

1.Roles of the Parties

User (Controller): The User determines the purpose and use of personal data entered into the platform.

DOOKE TECH (Processor): DOOKE LLC processes personal data only as instructed through platform functionality.

2.Types of Data Processed

• Names
• Email addresses
• Phone numbers
• CRM contact records
• Appointment data
• Marketing campaign data
• Website and funnel submissions
• Customer communication records

3.Purpose of Processing

• Provide CRM and automation functionality
• Deliver email and SMS communications
• Store customer records
• Manage workflows and appointments
• Support marketing campaigns
• Provide analytics and reporting

4.Processor Obligations

• Process personal data only for platform functionality
• Implement reasonable security safeguards
• Limit access to authorized personnel
• Maintain confidentiality of processed data

5.Subprocessors

The platform may use subprocessors such as hosting providers, email delivery services, SMS providers, payment processors, AI providers, and analytics infrastructure.

6.Data Security

DOOKE TECH implements reasonable administrative and technical safeguards to protect personal data, though no system can guarantee absolute security.

7.User Responsibilities

• Obtain consent before sending email or SMS messages
• Comply with privacy and marketing laws
• Maintain lawful basis for processing
• Ensure customer data accuracy

8.Data Retention and Deletion

Data is retained while accounts remain active and may be deleted after account termination, subject to backup retention and legal obligations.

9.International Data Transfers

Data may be processed in the United States or other locations where subprocessors operate.

10.Limitation of Liability

DOOKE LLC shall not be liable for indirect or consequential damages related to data processing.

11.Governing Law

This agreement is governed by the laws of the State of Florida, United States.
